Definitions

• Company / we / us / our: 123helmets OÜ (registry code 17409957), legal address: Harju maakond, Tallinn, Kesklinna linnaosa, Ahtri tn 12, 15551, Estonia.
• Customer / you: the person or entity placing an order.
• Products: full-size replica helmets and related accessories sold for display/collection purposes.
• Business Day(s): Monday–Friday, excluding public holidays at the shipping origin.
• Carrier: the shipping provider used for delivery (e.g., FedEx).
• Import Charges: import VAT, customs duties, and any carrier clearance/advancement fees.
• Custom/Personalized: any item made to your specifications or clearly personalized.
• DAP: Incoterms® 2020 Delivered At Place.

Collector / Display Disclaimer

Our replica helmets are display/collector replicas. They are not personal protective equipment (PPE) and are not certified for protective use (including road, track, or racing). You agree not to use any replica helmet as protective gear.

Orders & Acceptance

Placing an order

When you place an order, you make an offer to purchase. For a smooth checkout experience, review your Cart before payment and ensure your delivery details are correct at Checkout.

Acceptance

An order is accepted when we confirm shipment or otherwise confirm acceptance. We may decline or cancel an order if payment fails, the item is unavailable, or we reasonably suspect fraud.

Pricing & Payment (Stripe/PayPal)

Prices are shown in the currency displayed at checkout. Unless explicitly stated otherwise, prices do not include Import Charges. Payments are processed via Stripe and/or PayPal (depending on availability at checkout).

Delivery / Import Charges

Delivery terms (DAP) and import charges

All shipments are made under Incoterms® 2020 DAP (Delivered At Place). The customer is the importer of record unless otherwise stated and is responsible for import VAT, customs duties, and any carrier clearance/advancement fees upon delivery.
If the customer refuses to pay import charges and the shipment is returned, the seller may deduct return shipping and carrier fees from any refund, where permitted by applicable law.

Customs Holds & Delivery Issues

International shipments may be delayed by customs or carrier procedures. Tracking is provided when available, but customs clearance timelines are outside our control. If customs or the carrier requests information from you (as importer of record under DAP), please respond promptly.

Returns & Refunds

Returns and refunds are governed by our Return & Refund Policy, including RMA requirements, condition rules, and separate resolution paths for defects, wrong items, or transit damage.

Chargebacks & Payment Disputes

If you experience any issue with an order, please contact us first at hello@123helmets.com (we typically reply within 1–3 business days). Many issues can be resolved quickly without a chargeback. More help: Contact and FAQ.

Intellectual Property

Website content (text, images, designs, logos) is owned by us or our licensors and is protected by intellectual property laws. You may not copy or use it for commercial purposes without written permission.

Liability & Disclaimers

To the fullest extent permitted by law, the website and products are provided “as is” and “as available,” except where mandatory consumer rights apply. We are not liable for indirect or consequential losses. Nothing in these Terms limits liability that cannot be limited under applicable law.

Governing Law and Jurisdiction

These Terms are governed by Estonian law, without prejudice to mandatory consumer protections that may apply in your country of residence. Subject to mandatory law, disputes may be submitted to the courts in Estonia (Tallinn/Harju venue wording should be reviewed with counsel).
